1) Scope
1.1 These General Terms and Conditions (“GTC”) of Maison VYNE (“Seller”) apply to all contracts concluded between a consumer or entrepreneur (“Customer”) and the Seller for the delivery of goods listed in the Seller’s online shop. Diverging conditions of the Customer are rejected unless otherwise agreed.
1.2 These GTC also apply to contracts for the delivery of digital content unless explicitly stated otherwise.
1.3 These GTC also apply to contracts for the delivery of vouchers unless explicitly stated otherwise.
1.4 A consumer is any natural person who enters into a transaction for purposes not primarily related to commercial or self-employed activity. An entrepreneur is a person or entity who enters into a transaction for commercial or professional purposes.
1.5 Digital content refers to data not contained on a physical medium that is produced and made available in digital form, including specific usage rights as defined by the Seller.
2) Conclusion of the Contract
2.1 Product descriptions in the online shop are non-binding and serve to invite the Customer to submit an offer.
2.2 The Customer submits a binding offer by placing items in the cart and completing the order process using the online form.
2.3 The Seller may accept the Customer's offer within five days by:

Sending written or email confirmation;

Dispatching the ordered goods;

Requesting payment.
If none occurs, the offer is deemed rejected.
2.4 If PayPal is selected, contract conclusion occurs at the moment the Customer clicks the final order button.
2.5 The contract text is saved by the Seller and sent to the Customer in text form. It is not otherwise made available.
2.6 Input errors can be corrected using the browser and form controls before final submission.
2.7 The contract is concluded in English.
2.8 Communication is generally via email. Customers must ensure their provided address is functional.
3) Right of Withdrawal
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 Details can be found in the Seller’s cancellation policy.
3.3 The right does not apply to Customers outside the EU at the time of contract.
4) Prices and Payment
4.1 Prices include statutory VAT. Shipping costs are shown separately.
4.2 For non-EU deliveries, additional fees such as taxes, customs, or banking charges may apply and are the Customer’s responsibility.
4.3 Payment methods are listed in the online shop.
4.4–4.10 Payment processing may involve SOFORT, Shopify Payments, PayPal, Klarna, Stripe, or other third parties. Relevant conditions of those providers apply. All processing is subject to GDPR.
5) Delivery and Shipping
5.1 Goods are shipped to the address provided during checkout.
5.2 Failed deliveries due to Customer fault may incur extra charges.
5.3 Pickup by the Customer is not possible.
5.4 Digital content is delivered via email.
5.5 Vouchers are also delivered via email.
6) Granting of Rights of Use for Digital Content
6.1 Unless otherwise stated, Customers receive non-exclusive, perpetual, worldwide rights for private and commercial use.
6.2 Content may not be passed to third parties unless authorized.
6.3 Rights become active after full payment unless otherwise granted temporarily.
7) Retention of Title
The Seller retains ownership until full payment is received.
8) Liability for Defects (Warranty)
8.1 Legal defect liability applies.
8.2 Consumers should report visible damage upon receipt but are not obligated.
9) Custom Product Conditions
9.1 Customers must ensure legal use of submitted content (e.g. images/texts) and grant use rights.
9.2 Customers indemnify the Seller against legal claims related to such content.
9.3 Seller may reject content that is offensive, unlawful, or unethical.
10) Promotional Vouchers
10.1 Only valid during the stated period and for designated products.
10.2 Vouchers must be applied before checkout and cannot be combined.
10.3 No cash refund or interest. Vouchers are non-transferable.
10.4 Unused credit is forfeited upon return.
11) Gift Vouchers
11.1 Valid only in the Seller’s online shop.
11.2 Valid for 3 years from the end of the purchase year.
11.3 Not redeemable for cash or other gift vouchers.
11.4 Non-transferable; only usable by the named individual.
12) Applicable Law
12.1 Dutch law applies, excluding international sale law.
Consumers retain protection under local mandatory laws where applicable.
12.2 Choice of law does not apply for customers outside the EU.

13.2 Maison VYNE is not obligated or willing to participate in consumer arbitration procedures.
